Common Questions

Frequently Asked Questions

Do you guarantee bank, EIN, ITIN, or payment processor approval?

No. Banks, the IRS, payment processors, and financial institutions make independent decisions based on their own review criteria. What we do is structure, prepare, and position your application correctly to maximize your approval probability and reduce the risk of rejection. Approvals depend on your specific profile, documentation, and the institution involved. We set clear expectations before any application is submitted.

Am I required to visit the United States?

In most cases, no. The majority of our clients complete the entire process remotely from their home country including entity formation, tax identification, banking setup, and payment processor applications. Certain institutions may have specific requirements that affect this, which we identify and communicate clearly before beginning your engagement.

Can non-U.S. citizens open U.S. companies and bank accounts?

Yes. U.S. LLCs and Corporations can be formed and owned entirely by non-U.S. citizens and non-residents. There are no citizenship or residency requirements for ownership. U.S. bank accounts and payment processor accounts are also accessible to non-residents when the proper structure, documentation, and positioning are in place. Foreign ownership does trigger specific IRS reporting obligations that must be addressed from the beginning, we handle this as part of every engagement.

What states do you work with and why?

We primarily work with Wyoming and Delaware. Both states are specifically well-suited for foreign-owned U.S. entities for different reasons.

Wyoming offers strong privacy protections, no state income tax, low ongoing maintenance costs, and a straightforward compliance environment. It is generally the preferred choice for founders seeking operational simplicity and privacy.

Delaware is the preferred choice for venture-backed companies, businesses planning to raise capital from U.S. institutional investors, or founders who need a structure that U.S. investors and legal counterparties immediately recognize and accept.

The right state depends on your business model, banking strategy, and long-term goals. We assess this during the initial consultation and recommend accordingly.

Is this legal and compliant?

Yes. Every structure we implement is fully compliant with U.S. federal and state law. All services are handled by licensed U.S. professionals including CPAs, Enrolled Agents, and attorneys where required. We do not facilitate misrepresentation, concealment of ownership, or any attempt to bypass institutional or regulatory requirements. WeUSAServices does not operate as a government authority. We operate within lawful and regulatory boundaries on every engagement.

Do you provide legal or tax advice?

Yes, through licensed U.S. professionals on our team. WeUSAServices works exclusively with licensed and regulated U.S. tax professionals and legal specialists. This means the guidance you receive is not generic information, it is professional input provided in the context of your specific structure and situation. We do not provide advice through unlicensed personnel, and we do not offer one-size-fits-all recommendations. Every engagement begins with a review of your individual circumstances before any advice or recommendation is made.

Why is your service more expensive than $100 quick-start websites?

Because what those services provide and what you actually need are two different things. Most automated services file your LLC formation documents and stop there. They do not assess your banking readiness, review your IRS reporting obligations as a foreign-owned entity, structure your documentation for institutional review, or guide you through the credit and payment infrastructure that makes your U.S. entity functional.

The result is founders who have a company on paper but cannot open a bank account, get rejected by payment processors, or receive IRS penalty notices because required filings were never explained to them. The $25,000 IRS penalty for missed Form 5472 filings alone is more than the cost of our most comprehensive package.

We build complete, functional U.S. infrastructure, not certificates. The difference in price reflects the difference in what you actually receive.

Who is Package 3 really for?

Package 3, Elite Structuring & Asset Protection is designed for founders who have already established a U.S. presence and are now focused on protecting what they have built. It is appropriate for founders with significant or growing revenue, entrepreneurs seeking liability separation and privacy-focused structures, operators planning long-term U.S. integration, and individuals with estate planning or succession considerations.

It is not suitable for early-stage businesses or first-time founders who have not yet established basic U.S. infrastructure. If you are at that stage, Package 1 or Package 2 is the correct starting point. Package 3 is a consultation-based service, every structure is assessed and designed individually. There are no templates at this level.

How long does the overall process take?

Timelines vary depending on which services are involved and the complexity of your structure. As a general reference:

U.S. entity formation is typically completed within 1 business day after all required information is confirmed. EIN processing normally takes up to 7 business days, and rarely up to 6 weeks depending on IRS volume. ITIN processing typically takes 6–16 weeks depending on IRS volume and time of year. Banking setup timelines vary by institution — some accounts can be opened within 1–2 weeks, others may take 4–8 weeks depending on the institution and your profile. Advanced structuring timelines depend on complexity and are assessed individually during consultation.

All timelines are communicated clearly before any engagement begins. We do not make guarantees on processing times as these depend on third-party institutions and government agencies outside our control.

What is an ITIN and do I really need one?

An ITIN, Individual Taxpayer Identification Number is your personal U.S. tax identification number as a non-resident individual. It is different from an EIN, which is your business tax ID. The ITIN is issued to you personally and is used for personal U.S. banking applications, U.S. credit card applications as a non-resident, personal U.S. tax reporting where applicable, and building a U.S. credit profile over time.

Whether you need one depends on your goals. If you want a stable, long-term relationship with U.S. banks and financial institutions including access to personal U.S. accounts and credit, having an ITIN significantly strengthens your position. Many international founders underestimate how important the ITIN is until they encounter friction with banking and credit applications that require it.

In the majority of cases, obtaining an ITIN does not make you liable to pay U.S. taxes. Tax liability depends on your country of residence, citizenship, business activity, and applicable tax treaties, not on having an ITIN. This is reviewed individually as part of your overall structure assessment.
